These Terms & Conditions (“Terms”) govern your access to and use of casalegame.com and any related pages, content, products, and services offered by Casa Legame LLC doing business as Casa Legame (“Casa Legame,” “we,” “us,” or “our”). By visiting the site, creating an account, or placing an order, you agree to these Terms and to our Privacy Policy and Return Policy.

1. Eligibility and use of the site

You must be at least the age of majority in your place of residence, or use the site with the involvement of a parent or legal guardian. You may use the site only for lawful, personal purposes and in accordance with these Terms.

You may not misuse the site, interfere with its security or operation, attempt unauthorized access, introduce malicious code, scrape or reproduce site content at scale, use the site to violate another person’s rights, or use our products or content for unlawful commercial activity.

2. Accounts

If you create an account, you are responsible for providing accurate information, maintaining the confidentiality of your credentials, and promptly notifying us of suspected unauthorized use. We may suspend or close an account when reasonably necessary to protect customers, Casa Legame, or the integrity of the site.

3. Products and natural materials

Casa Legame creates sculptural vessels and related objects for pets. Product photographs and descriptions are provided to help you understand a piece, but screen settings, lighting, scale, and the character of natural materials may affect how an item appears.

Stone is inherently varied. Veining, tonal shifts, mineral deposits, small pits, fissures, texture, and minor dimensional variation are part of the material and make each piece distinct. These natural characteristics are not defects. A structural crack, sharp break, manufacturing failure, or material difference that makes a product unsuitable for its stated use may be a defect and should be reported to us.

4. Pet use and care

Use each product only for its described purpose and follow the product page and care instructions. Casa Legame products are not chew toys. Place vessels on a stable, protected surface, lift rather than slide them, and keep them away from edges where they could fall. Inspect a vessel regularly and discontinue use if it becomes cracked, chipped, unstable, or sharp.

IMPORTANT SAFETY WARNING. Casa Legame vessels are made of heavy natural stone (such as marble or granite) and are not toys. Dropping, throwing, or striking a vessel can cause it to chip, crack, or break into sharp pieces that may injure you, another person, or your pet, or damage floors and surfaces. Keep vessels away from stairs and edges, do not allow pets or children to carry or play with them, and supervise your pet’s use. Stop using any vessel immediately if it becomes chipped, cracked, unstable, or develops a sharp edge, and keep it out of your pet’s reach. Choose a size and form appropriate for your animal, and consult a qualified veterinarian with any health questions.

Information on the site is not veterinary, medical, or professional advice. If you have questions about your pet’s feeding, hydration, allergies, mobility, or health, consult a qualified veterinarian.

5. Orders and acceptance

Submitting an order is an offer to purchase. We may accept, decline, or cancel an order for legitimate reasons such as inventory limitations, suspected fraud, shipping restrictions, legal requirements, or an obvious pricing or description error. If we cancel after payment, we will refund the amount charged for the cancelled item.

Please review your delivery address, personalization, quantity, and product details before submitting an order. Contact us promptly about a requested change or cancellation. We cannot guarantee changes or cancellations once fulfillment, sourcing, personalization, or production has begun. After that point, the purchase is final except where required by law.

6. Prices, taxes, and payment

Prices are shown in the currency displayed on the site and may change without notice before an order is placed. Shipping charges, taxes, duties, and other applicable fees are shown when available at checkout. Payment is due when the order is submitted and is processed by Shopify or another payment provider. Your use of a payment method is also subject to the provider’s terms.

7. Shipping and delivery

Processing and delivery estimates are estimates, not guarantees. Made-to-order or limited pieces may require additional production time, which will be stated on the relevant product page or order communication.

If a material delay occurs, we will contact you with a revised estimate and, where required, the option to accept the delay or cancel the affected order for a refund. Please inspect delivery information carefully. We are not responsible for delay or non-delivery caused by an incorrect address supplied by the customer, subject to applicable law.

8. Returns and damaged items

All products are final sale and are not eligible for return or exchange, except when an item arrives damaged, defective, or incorrect, or where applicable law requires otherwise. Our Return Policy is incorporated into these Terms. Natural stone variation is not a defect. Nothing in these Terms limits rights that cannot lawfully be excluded.

9. Promotions, gift cards, and discounts

Promotions, discount codes, and gift cards are subject to any additional terms presented with them. Unless expressly stated, promotions cannot be combined, have no cash value, and may be modified or ended before an order is placed. Gift cards are not refundable except where required by law.

10. Intellectual property

The site and its content—including the Casa Legame name and marks, product names, photographs, text, graphics, design, layouts, video, and other creative material—are owned by or licensed to Casa Legame and are protected by intellectual-property laws. You may view and use the site for personal shopping and informational purposes. No other license is granted.

You may not copy, publish, modify, distribute, sell, create derivative works from, or commercially exploit our content without prior written permission, except as permitted by law.

11. Reviews and customer content

If you submit a review, photograph, comment, or other content, you represent that you have the right to provide it and that it is accurate, lawful, and not misleading or infringing. You grant Casa Legame a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and share that content for operating and promoting the business, unless otherwise agreed in writing. You retain ownership of your content.

We may moderate or remove content that violates these Terms, but we are not obligated to publish every submission.

12. Third-party services and links

The site may use or link to services operated by third parties, including Shopify, payment processors, shipping carriers, social platforms, analytics providers, and other applications. Their services are governed by their own terms and privacy practices. We are not responsible for third-party sites or services that we do not control.

13. Disclaimers

We aim to keep the site accurate and available, but we do not promise that it will always be uninterrupted, error-free, or free of harmful components. To the fullest extent permitted by law, the site and services are provided “as is” and “as available,” except for express product commitments and rights that cannot lawfully be excluded. We do not disclaim warranties or remedies that applicable consumer law requires.

14. Limitation of liability

To the fullest extent permitted by law, Casa Legame and its owners, employees, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the site, services, or products. Our aggregate liability for a claim relating to a product will not exceed the amount paid for the product giving rise to the claim.

These limits do not apply where prohibited by law, including to liability that cannot be limited for personal injury, fraud, gross negligence, willful misconduct, or applicable statutory consumer rights.

15. Indemnification

To the extent permitted by law, you agree to indemnify and hold Casa Legame harmless from third-party claims, losses, or reasonable costs arising from your unlawful misuse of the site, violation of these Terms, or infringement of another person’s rights. This section does not require a consumer to indemnify us for our own negligence or misconduct.

16. Governing law and disputes

These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law principles, except that mandatory consumer protections in your place of residence continue to apply. Any dispute not resolved informally will be brought in a court with proper jurisdiction in Connecticut, unless applicable law gives you the right to proceed elsewhere.

Before filing a claim, please contact us so we can try to resolve the issue in good faith.

BINDING ARBITRATION AND CLASS ACTION WAIVER. PLEASE READ THIS SECTION CAREFULLY, AS IT AFFECTS YOUR LEGAL RIGHTS. Except for the informal resolution process above, claims that may be brought in small-claims court, and actions to protect intellectual-property rights, any dispute, claim, or controversy arising out of or relating to these Terms, the site, or our products that is not resolved informally will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, and not in court, except where applicable law provides otherwise. The arbitration may, at Casa Lagame’s discretion, take place in Connecticut, in your county of residence, or by videoconference or telephone.

You and Casa Legame agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims or preside over any form of class or representative proceeding. If this class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will proceed in court rather than in arbitration.

Your right to opt out. You may opt out of this arbitration agreement within 30 days after first accepting these Terms by emailing hello@casalegame.com with the subject line “Arbitration Opt-Out” and stating your name, your order or account information, and your intent to opt out. Opting out will not affect any other provision of these Terms. Nothing in this section prevents you from exercising rights that cannot lawfully be waived, and this section does not apply where prohibited by applicable law.

17. Changes to these Terms

We may update these Terms from time to time. The revised Terms will be posted with a new “Last updated” date and will apply prospectively. If a change materially affects your rights, we will provide additional notice when required by law.

18. General terms

If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with policies incorporated by reference and any order-specific terms, are the entire agreement between you and Casa Legame concerning the site and your purchase.
